Terms of Service

This is a starting draft, not reviewed by a solicitor — get that review done before relying on it commercially, given it governs real payments and access to people's tenancy documents.

1. Who we are and acceptance

These Terms of Service ("Terms") govern your use of RentClarity, operated by [PLACEHOLDER — registered company name, company number, registered address once incorporated]. By creating an account or using RentClarity, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.

2. What RentClarity is — and isn't

RentClarity uses AI to review documents you upload against a fixed checklist of renter-protection law for your UK nation (England, Wales, Scotland, or Northern Ireland), and flags potential issues in plain English.

RentClarity is not a law firm, does not provide legal advice, and no solicitor-client relationship is created by using it. Output is AI-generated general guidance only. It may be incomplete, outdated, or wrong. It does not account for the specific facts of your situation the way a solicitor would, and must not be relied on as a substitute for professional legal advice. For anything involving a dispute, eviction, or money at stake, contact Shelter, Citizens Advice, or a solicitor.

3. Eligibility and your account

  • You must be at least 18 years old and able to form a binding contract in the UK.
  • You must provide accurate information and keep your password confidential.
  • You are responsible for all activity under your account.
  • Tell us immediately if you suspect unauthorised access to your account.

4. Fees, payment, and cancellation rights

Your first tenancy check is free. Beyond that, you can unlock an individual check for a one-off fee, or subscribe to unlock unlimited checks for a recurring annual fee. Current prices are shown in the app before you pay and are inclusive of any applicable VAT.

All payments are processed by Stripe. We do not store your full card details.

Subscriptions automatically renew each year at the then-current price until you cancel. You can cancel any time through the billing portal in your dashboard; cancellation takes effect at the end of the current paid period, and you keep access until then. We do not provide partial refunds for the unused portion of a subscription period.

Right to cancel (cooling-off period): Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you normally have 14 days to cancel an online purchase of digital content or services without giving a reason. However, because a tenancy check report is delivered to you immediately/near-immediately after payment, by paying you expressly request that we begin providing it straight away, and you acknowledge that once the report has been fully provided to you, you lose the right to cancel under these Regulations for that purchase. This does not affect your other statutory rights (see Section 8).

[BUILD GAP] This cooling-off acknowledgment should also be presented as an explicit checkbox at the point of purchase (in the Stripe Checkout flow or immediately before it), not only written here — that is the more defensible way to show the "express request and acknowledgment" the Regulations require. Not yet built.

5. Refunds

Because reports are delivered instantly as digital content, fees are generally non-refundable once a report has been generated, subject to Section 4 and your statutory rights under Section 8. If something goes wrong on our end — for example, you paid but the checklist review failed to run — contact us and we will investigate and refund you where appropriate.

6. Acceptable use

You agree not to:

  • Upload documents you do not have the right to upload or share with us
  • Use the service for any unlawful purpose
  • Attempt to reverse-engineer, scrape, or interfere with the service, or circumvent payment
  • Upload malicious files or attempt to compromise the security of the service
  • Impersonate any person or misrepresent your affiliation with any person or entity

We may suspend or terminate accounts that breach this section.

7. Intellectual property

We own the RentClarity service, software, branding, and the structure/wording of the checklists themselves. You keep all rights to the documents you upload. By uploading a document, you grant us a limited licence to process it (including sending it to our AI provider) solely to provide the service to you. We do not claim ownership of your documents or use them to train AI models.

8. Liability

Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot lawfully be limited or excluded under UK law. If you are a consumer, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015, including your rights in relation to services and digital content not being performed with reasonable care and skill, or not being as described.

Subject to the above, to the fullest extent permitted by law: the service is provided "as is", output may be inaccurate or incomplete, and we are not liable for decisions you make in reliance on it. Our total liability to you for any claim arising from your use of the service is limited to the amount you paid us in the 12 months before the claim arose. We are not liable for indirect or consequential losses (such as loss of a legal case, loss of a tenancy, or loss of profit).

9. Termination

You may stop using the service and cancel any subscription at any time. We may suspend or terminate your account if you breach these Terms, or if we reasonably believe your account is being used fraudulently or unlawfully. On termination, Sections 7, 8, and 11 continue to apply.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you before they take effect. Continued use of the service after changes take effect means you accept the updated Terms.

11. Governing law and your local rights

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have non-exclusive jurisdiction over any dispute. If you are a consumer resident in Scotland, Wales, or Northern Ireland, this choice of law does not remove any mandatory consumer protections you are entitled to under the law of your own place of residence, and you may also be able to bring proceedings in the courts of that jurisdiction.

12. Complaints and contact

If we cannot resolve a complaint directly and you are a consumer, you may be entitled to use an alternative dispute resolution (ADR) service or the EU/UK Online Dispute Resolution options where applicable.
